Minutes of the fifth metting of the joint coordination committee on the Cambodia – Laos – Vietnam development triangle area Banlung, Ratanak Kiri Province, Cambodia 18 March 2010

1.The 5th Meeting of the Joint Coordination Committee on the Cambodia- Laos-Vietnam (hereafter referred to as the CLV JCC) Development Triangle Area was held on 18 March 2010 in Banlung, Ratanakiri Province, Cambodia. The JCC Meeting is Co-chaired by:
-  H.E. Mr. CHAM Prasidh, Senior Minister, Minister of Commerce of the Kingdom of Cambodia, Chairman of the Coordination Committee for Cambodia;
-  H.E. Mr. VO Hong Phuc, Minister of Planning and Investment of the Socialist Republic of Viet Nam, Chairman of the Coordination Committee for Viet Nam;
-  H.E. Dr. Sinlavong KHOUTPHAYTHOUNE, Minister of Planning and Investment of the Lao People's Democratic Republic, Chairman of the Coordination Committee for Lao PDR.
The Meeting is attended by senior officials and representatives from ministries and 13 provinces of Cambodia, Lao PDR and Viet Nam. The lists of delegates of Cambodia, Lao PDR and Viet Nam appear as Annex 1, 2 and 3 respectively.
2. In his welcoming remark, H.E. Mr. CHAM Prasidh, Senior Minister, Minister of Commerce highly appreciated the participation of the delegations from Lao PDR and Viet Nam to the 5th JCC Meeting. H.E. Dr. Sinlavong KHOUTPHAYTHOUNE and H.E. Mr. VO Hong Phuc expressed their appreciation and congratulation to Cambodia for excellent arrangements and successful organization of the JCC Meeting, sub-committee meetings, Conference on Trade, Investment and Tourism Promotion, and other side events organized back-to-back with the 5th JCC Meeting. In their remarks, the Ministers reiterated their appreciation of the inherent and traditional friendship and multi-faceted cooperation among the people of CLV, which serve as an important foundation for peace, stability and development of the CLV DTA and also expressed the need to accelerate the cooperation among CLV in developing the DTA as mandated by the three Prime Ministers at the 5th CLV Summit. The remarks of H.E. Mr. CHAM Prasidh, H.E. Dr. Sinlavong KHOUTPHAYTHOUNE and H.E. Mr. VO Hong Phuc appear as Annex 4, 5 and 6 respectively.
3. At the Meeting, the Ministers discussed the progress reports of the Senior Officials Meeting which covered the following issues: (i) progress report on implementation of the MOU toward the formulation of Special Preferential Policies for the Development Triangle Area (DTA); (ii) status of updating and adjusting the Socio-economic development Master Plan for Cambodia-Laos-Viet Nam Development Triangle Area for 2010 - 2020; (iii) the development progress on setting up a website in Cambodia and Laos; (iv) the following up and preparation for CLV plus Japan Working Level Meeting to be held on 30 March 2010 in Hanoi; (v) the outcome of the 5th Conference on Trade, Investment and Tourism Promotion and CLV Trade Fair held on 13-15 March 2010 in Banlung, Ratanak Kiri; (vi) outcome of CLV Youth Forum held on 13 March 2010 in Banlung, Ratanak Kiri; (vii) development progress in social and environmental sector; (viii) progress on security and foreign affairs; and (ix) outcome of the cooperation among the 13 provinces in the CLV DT. The Ministers also discussed the preparation for the 6th CLV Summit to be held in November 2010 in Cambodia, and the rules of procedures for CLV meetings. The CLV JCC Meeting Agenda appears as Annex 7.
4. The Ministers express their satisfaction with the progress reports of all sub-committees to SOM and encouraged all sub-committees to harder to accomplish the tasks assigned by the JCC. The minutes and progress reports of the Economic Sub-committee, the Security and Foreign Affairs Sub-committee, the Social and Environmental Sub-committee, and the Provincial Coordination Sub-committee appear as annex 8, 9, 10 and 11 respectively.
5. After listening to the report of SOM, which appears as annex 12, on the outcomes of all sub-committee meetings and other side events to 5th JCC, the Ministers made the following recommendations:
- The Ministers express their satisfaction for the progress made by CLV in the implementation of the MOU toward the formulation of Special Preferential Policies for the Development Triangle Area signed on 26 November 2008 on the side line of the 5th CLV Summit in Vientiane, Lao PDR;
- The Ministers highly appreciate the effort of Viet Nam in formulating the first draft of revised Master Plan and agreed with the working schedule proposed by SOM for revising and updating the Socio-Economic Development Master Plan until November 2010 and urged Cambodia and Lao PDR to closely cooperate with Viet Nam’s MPI Team to effectively implement the schedule. The Ministers also stressed the importance of finalization of the revised Master Plan and asked each CLV country to consider hosting joint meetings as neccesary on a voluntary basis in order to finalize the Revised Master Plan as soon as possible before the 6th CLV Summit;
- With the agreement of the Ministers at the 4th JCC Meeting in Dak Lak to add 3 more provinces (Kratie Province of Cambodia, Champasak Province of Lao PDR and Binh Phuoc Province of Viet Nam) to the CLV DTA, taking into account the issues and recommendations of sub-committee reports regarding the implementation of MOU, the Ministers tasked economic sub-committee in colaboration with other sub-committees to review and amend the MOU for signing by the Ministers at the next JCC Meeting.
- In order to promote business activities among provinces along the border area of CLV DTA, the Ministers agreed that provincial authorities and provincial offices of commerce organize border trade fairs at the appropriate time and venue with participation of private companies;
- The Ministers agreed to task Economic Sub-committee to colaborate with other sub-committees to study in details the good practices of the implementation of Single Stop Inspection at Dansavan-Lao Bao border gate and report to the JCC the possibility of application of Single Stop Inspection in the CLV DTA; and the Ministers task Economic Sub-committee to produce a common list of products subject to receiving special and preferential treatment.
- The Ministers recognised the importance of alignment and harmonization of trade and investment-related incentives for promoting trade and investment in CLV DTA.    
- The Ministers congratulate the successful organization of the 5th Conference on Trade, Investment and Tourism Promotion held in Banlung and suggested that CLV should encourage more investors and businessmen to actively participate in the next Conference; and
- As stated in the Joint Statement of the Fifth CLV Summit on CLV Development Triangle Area held in November 2008 in Vientiane, the Ministers agreed that each country has to coordinate with business people to arrange the CLV Business Forum back-to-back with the 6th CLV Summit in Cambodia.
6. The Ministers have discussed the rules of procedures for all CLV Meetings and decided as follow:
- The Security and Foreign Affairs Sub-committee and Economic Sub-committee are encouraged to use English for their discussion; and Social and Environmental Sub-committee and Provincial Coordination Sub-committee can use English or Khmer, Laotian and Vietnamese languages for their discussions with simultaneous interpretation;
- The official documents for all CLV meetings shall be in English;
- The Ministers also agreed that the level of heads of delegations from CLV to the sub-committee meetings must be at the director-general level. As certain decision may be made at SOM Meeting, the head of delegation shall be at the vice minister level and for the CLV plus Japan Working Level Meeting or other similar meetings with development partners, the head of delegation from CLV shall be at the director-general level;
- Regarding frequency of CLV Meeting, the Ministers agreed that JCC should convene its regular meeting once a year and informal JCC meetings could be convined if needed. All sub-committee meetings and SOM shall convene their meetings back-to-back with JCC. However, CLV can voluntarily host the joint meetings of all sub-committees and informal JCC Meeting or preparatory JCC meeting before the Summit as necessary;
- The Ministers suggested the Sub-committee on Social and Environment to strengthen the cooperation in education including the formulation of the training program to build capacity of officials of CLV DTA in the areas of languages (English, Khmer, Laotian and Vietnamese), vocational skills and post graduate education. The Ministers will coordinate with individual government and donors to get this training program implemented in 2010; and
- The Ministers suggested all sub-committees to assign its own focal point for the effective coordination and communication. However, all communications shall be copied to the focal points of CLV JCC and their secretariats.
7. In order to facilitate the movement of people living in 13 provinces of CLV DTA, the use of common border pass of CLV DT was proposed by Cambodia. In this regard, the Ministers tasked the Security and Foreign Affairs Sub-committee to study in details and report to the next JCC meeting for consideration.
8. For coordination and preparation for the next CLV Plus Japan Working Level Meeting, the Ministers urged CLV to accomplish the implementation of the projects funded with $20 Million under Japan-ASEAN Integration Fund. The Ministers also advised that CLV delegations to participate in such meeting shall follow up with Japan on the flagship projects submitted by CLV Prime Ministers in November 2004 and projects submitted by CLV at the last CLV plus Japan Working Level Meeting held on 11 August 2009 in Vientiane, Lao PDR. The delegations of CLV are suggested to propose to Japan new areas of cooperation such as climate change, natural disaster management, cross- border pandemic deseases , etc.
9. The Ministers recognize the importance of ensuring security and safety of investors and inhabitants in CLV DTA, including UXO issue.
10. The Ministers welcomed the success of the organization of the CLV Youth Forum held on 13 March 2010 in Banlung, Ratanak Kiri Province, Cambodia. The Meeting also welcome the Joint Declaration of CLV Youth Forum and asked related CLV sub-committees to mobilize financial support funding trainging projects for CLV DTA youth.
11. On the preparation of 6th CLV Summit in November 2010, Cambodia will send to Laos and Viet Nam the program of activities and tentative agenda for the Summit through diplomatic channels in due course.
12. The Ministers expressed their appreciation to the Lao PDR for accepting to host the next JCC and Sub-Committee Meetings tentatively in November 2011 in Attapeu Province of Laos and date of such meetings will be informed through diplomatic channels. The Ministers agreed to hold a JCC informal meeting back-to-back to the 6th CLV Summit in Phnom Penh, Cambodia.
13. Once again the Ministers congratulate Cambodia for the successful organization of all meetings and side events to CLV JCC. The Chairmen of the Coordination Committees of Lao PDR and Viet Nam expressed their high appreciation to the Royal Government of Cambodia and the Ministry of Commerce of Cambodia for the warm hospitality and excellent arrangements of the Conference, all Sub-committee Meetings, and the 5th Joint Coordination Committee Meeting held from 13-18 March 2010 in Banlung, Ratanak Kiri Province, Cambodia. The Co-chairmen also expressed their appreciation to Ratanak Kiri Province for the hospitality and assistance extended to all delegations during their stay and mission here in Banlung, the beautiful town of Ratanak Kiri Province of the Kingdom of Cambodia.
